The arbitration shall be conducted in Indianapolis, Indiana, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Broyles, Kight & Ricafort, P.C. may seek any interim or preliminary relief from a court of competent jurisdiction in Indiana necessary to protect the rights or property of Broyles, Kight & Ricafort, P.C. pending the completion of arbitration.

NEITHER BKRLAW NOR ANY OF ITS AFFILIATES, AGENTS OR REPRESENTATIVES SHALL BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR INJURY OR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES ARISING OUT OF YOUR ACCESS OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SITE OR ANY SERVICES, MATERIALS, OPINIONS OR RECOMMENDATIONS OF THIRD PARTIES ON THE SITE. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
